This privacy policy (“Policy”) describes how the personally identifiable information (“Personal Information”) you may provide on the learn.yogajaya.com website (“Website”) and while using and of their related products and services (collectively, “Services”) is collected, protected and used. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is a legally binding agreement between you (“User”, “you” or “your”) and YogaJaya Intl. (“YogaJaya”, “we”, “us” or “our”). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the Terms and Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

What information we collect

Automatically collected information

When you visit or log in into the Website, we may track, collect, and aggregate information that your browser or device sends. This data may include information such as your device’s IP address and location, browser and device name and version, operating system type and version, language preferences, the webpage you were visiting before you came to the Website, pages of the Website that you visit, the time spent on those pages, information you search for on the Website, access times and dates, and other statistics.

Such information collected automatically is used to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Website. Location data may be used to route your traffic to the nearest regional server to reduce latency and improve your experience. We may also use cookies and web beacons when you visit our Website. Collection of personal information

We receive and may store any information you knowingly provide to us when you create an account, make a purchase, interact with the Website, participate in live In-Person sessions provided as part of our Services, publish content, or fill any online forms on the Website. 

We may use the Personal information that you provide to respond to your questions, provide you the specific Services you select, send you updates about offered Services, and send you email messages about Website maintenance or updates.

We gather the following types of information about users through the Website:

Account creation and payment

In order to create an account on the Website, you have to go through a checkout process, where you will be required to provide your full name, email address, phone number, payment details, and billing address. You can create a username and set a display name in such a way that other users of the website cannot identify who you are. The username you create will be used as a slug for your member’s page, therefore we strongly advise to avoid using your email address as your username.

The website provides you with the ability to pay using a credit card or other methods through a third party payment processing service provider. Please note that our service provider – not YogaJaya – collects and processes your financial information.

If your subscription plan expires, you retain the ability to login into your account on the Website and edit your personal information, although some paid content will no longer be available to you.

Using the online content

If you engage with the online content, we collect information such as lesson progress, responses to quizzes and exams, and other information related to your engagement with the content. Providing you with a summary of this information to you is a part of the Services we offer to you.

Using Services involving in-person Services 

If you wish to use some of the features on the Website (including any of the Services provided in the form of in-person sessions), you will be asked to provide additional Personal Information. 

When required, this information may include the following:

  • An avatar including a headshot which shows your face clearly to allow our teaching staff and other participants to identify you during in-person interactions.
  • Personal details such as name, country and city of residence, gender, etc.
  • Contact information such as email address, address, etc.
  • Personal information related to certain past experiences and habits, certain medically-relevant information, and other information that may be relevant to determining your eligibility to participate in in-person sessions.
  • Information about other individuals such as your family members, friends, etc.
  • Video-recordings of in-person sessions you choose to participate in.
  • Any other materials you willingly submit to us such as inquiries, images, feedback, survey responses, your posts at social groups and forums etc.

You can choose not to provide us with your Personal Information, but then you may not be able to take advantage of some of the features on the Services. Users who are uncertain about what information is mandatory are welcome to contact us.

Third Party sites and Partner sites

We may also collect Personal Information about you from other sources such as public databases, social media platforms, third-party data providers, and our joint marketing partners. Personal Information we collect from other sources may include demographic information, such as age and gender, device information, such as IP addresses, location, such as city and state, and online behavioral data, such as information about your use of social media websites, page view information and search results and links. If you have ever participated in any in-person event organized by YogaJaya, we may have access to the information you have previously provided to YogaJaya, such as your purchase history, class attendance history etc.

How we use and process the collected personal Information

In order to make the Services available to you, or to meet a legal obligation, we need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested products or services. 

Any of the information we collect from you may be used for the following purposes:

  • Create and manage user accounts
  • Fulfill and manage orders
  • Deliver content and Services
  • Improve content and Services
  • Offer technical support and security 
  • Send administrative information
  • Send marketing and promotional communications
  • Respond to inquiries and offer support
  • Request user feedback
  • Improve user experience
  • Post customer testimonials
  • Deliver targeted advertising
  • Administer prize draws and competitions
  • Enforce Terms and policies
  • Protect from abuse and malicious users
  • Respond to legal requests and prevent harm

Except as set forth in this Privacy policy or as specifically agreed to by you, YogaJaya will not disclose any of your Personal Information. We may disclose and otherwise use certain kinds of Personal Information as described below.

  • Feedback/social groups/forum posts.
    When you provide us with feedback, or post in social groups or forums, we may archive this information and/or use it for future communications with you, or our business partners, or teaching staff associated with the online content and in-person sessions you have taken. We may also use or publish excerpts of your feedback/social groups/forum submissions with or without your first name/display name and avatar, but without using any other personally identifiable information.
  • Participation in online learning and in-person Services.
    The details of your online learning progress as well as any information you provide during in-person sessions may be shared with the instructor or instructors who taught any part of the learning content, or who have been assigned to offer in-person teaching to you. We may also use the information generated when using the online content or in-person Services for predictive analysis of your performance. Also, we may archive this information and/or use it for future communications with you, where we are legally entitled to do so.
  • Screen/Video recordings.
    Some Services involve live in-person meetings, either one-on-one between you and a teaching staff, or in a form of group meetings with the teaching staff, you, and other participants. Such meetings require the camera to be turned on during the meeting. Such meetings may be recorded by our teaching staff and automatically uploaded to be stored on our secure server. These recordings may be retained for a certain period of time on our server, where they may be accessed by our teaching staff for training purposes, for the purpose of improving the quality of our Services, or in order to and/or use it for future communications with you.
    Please note that we do not offer Services that involve providing any users with access to video recordings involving multiple participants.
    Some Services require you to submit a URL to a video file showing yourself and other individuals. In such cases, if the URL can be viewed online, the assigned teaching staff will review it online. If the URL you provided requires downloading the file in order to view it, our teaching staff will download the file to temporarily store it on their personal computer’s hard drive and will delete it as soon as they have fulfilled their obligation to you in providing the Service in relation to the video file. We advise that you provide us with URLs to files that can be viewed online.
  • Communications with or from YogaJaya.
    When you send us an email message or otherwise contact us, we may use the information provided by you to respond to your communication and/or as described in this Privacy Notice. We may also archive this information and/or use it for future communications with you where we are legally entitled to do so. Where we send you emails, we may track the way that you interact with these emails (such as when you open an email or click on a link inside an email). We use this information for the purposes of optimizing and better tailoring our communications to you.
  • Research.
    We may share general course data (including quiz or assignment submissions, grades, and forum discussions), information about your activity on our Site, and demographic data from surveys operated by us with our content providers and other business partners so that content providers and other business partners may use the data for research related to online education or effects of physical practices.
  • Disclosure to YogaJaya operations and maintenance contractors.
    We use various service providers, vendors, and contractors (collectively, “Contractors”) to assist us in providing our Services to you. Our Contractors may have limited access to your Personal Data in the course of providing their products or services to us, so that we in turn can provide our Services to you. These Contractors may include vendors and suppliers that provide us with technology, services, and/or content related to the operation and maintenance of the Site or the Content Offerings. Access to your Personal Data by these Contractors is limited to the information reasonably necessary for the Contractor to perform its limited function for us.
  • Government Authorities; Legal Rights and Actions.
    YogaJaya may share your Personal Data with various government authorities in response to subpoenas, court orders, or other legal processes; to establish or exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us. We also may share your Personal Data when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of YogaJaya, the Website, our users, customers, or others; and in connection with our Terms and other agreements.
  • Disclosure to Acquirers.
    YogaJaya may disclose and/or transfer your Personal Data to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the equity, business, or assets of YogaJaya to which your Personal Data relates.

Processing your Personal Information depends on how you interact with the Services, where you are located in the world and if one of the following applies: (i) you have given your consent for one or more specific purposes; this, however, does not apply, whenever the processing of Personal Information is subject to California Consumer Privacy Act or European data protection law; (ii) provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which you are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.

Note that under some legislations we may be allowed to process information until you object to such processing (by opting out), without having to rely on consent or any other of the following legal bases below. In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Billing and payments

We use third party payment processors to assist us in processing your payment information securely. Such third party processors’ use of your Personal Information is governed by their respective privacy policies which may or may not contain privacy protections as protective as this Policy. We suggest that you review their respective privacy policies.

Managing information

You are able to delete certain Personal Information we have about you. The Personal Information you can delete may change as the Services change. When you delete Personal Information, however, we may maintain a copy of the unrevised Personal Information in our records for the duration necessary to comply with our obligations to our affiliates and partners, and for the purposes described below. If you would like to delete your Personal Information or permanently delete your account, you can do so by contacting us.

Disclosure of information

Depending on the requested Services or as necessary to complete any transaction or provide any service you have requested, we may share your information (which is reasonably necessary for that particular purpose) with our trusted third parties that work with us, any other affiliates and subsidiaries we rely upon to assist in the operation of the Services available to you. We do not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. We may share your Personal Information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to Personal Information. We will disclose any Personal Information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

In the event we go through a business transition, such as a merger or acquisition by another company, or sale of all or a portion of its assets, your user account, and Personal Information may be among the assets transferred.

Retention of information

We will retain and use your Personal Information for the period necessary to comply with our legal obligations, resolve disputes, and enforce our agreements unless a longer retention period is required or permitted by law. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.

Our Website use “cookies” to help personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

We may use cookies to collect, store, and track information for statistical purposes to operate the Website and provide our Services. You have the ability to accept or decline cookies. We are committed to keeping your e-mail address confidential and will not disclose your email address to any third parties except as allowed in the information use and processing section or for the purposes of utilizing a third party provider to send such emails. We will maintain the information sent via e-mail in accordance with applicable laws and regulations.

In compliance with the CAN-SPAM Act, all e-mails sent from us will clearly state who the e-mail is from and provide clear information on how to contact the sender. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting us. However, you will continue to receive essential transactional emails.

For your convenience we may provide links to other third party resources that are not owned or controlled by us that we believe may be of interest to you. We do not disclose your Personal Information to these third party resources unless we have a lawful basis on which to do so. Please be aware that we are not responsible for the privacy practices of such other resources or third parties. We encourage you to be aware when you leave the Services and to read the privacy statements of each and every resource that may collect Personal Information.

The rights of users

You may exercise certain rights regarding your information processed by us.   • You also have the right to withdraw your consent at any time where YogaJaya relied on your consent to process your Personal Information.

In addition to the rights as explained in this Policy, California residents who provide Personal Information (as defined in the statute) to obtain products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the Personal Information we shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared such personal information for the immediately prior calendar year (e.g., requests made in the current year will receive information about the prior year). Please note that we may ask you to verify your identity before responding to such requests. Your request must provide sufficient information that allows us to verify that you are the person you are claiming to be or that you are the authorized representative of such person. You must include sufficient details to allow us to properly understand the request and respond to it. We cannot respond to your request or provide you with Personal Information unless we first verify your identity or authority to make such a request and confirm that the Personal Information relates to you.

Information security

We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. We recognize the need to provide further privacy protections with respect to Personal Information we may collect from children and take many special precautions to protect the privacy of children. 

Any use or access by anyone under the age of 18 is prohibited. We do not knowingly collect or maintain Personal Information on our Website from persons under 18 years of age, and no part of our Website is directed to persons under 18 years of age. If you are under 18 years of age, then please do not use or access this Website at any time or in any manner. We will take appropriate steps to delete any Personal Information of persons less than 18 years of age that has been collected on our Site without verified parental consent upon learning of the existence of such Personal Information, except for the Information that we are legally required to retain.
