YOGAJAYA EDUCATION offers products and services provided by YogaJaya Intl., a company incorporated in Canada, and our international partners, including Para Impacto Ltd., a company, incorporated in Japan (collectively, “YogaJaya”, “us,” “we,” or “our”).

These Terms of Use (“Terms”) govern your use of our website, apps, and other products and services (“Services”). Please read these Terms carefully and contact us if you have any questions, requests for information, or complaints. By completing any form of payment, registering an account on this website, or iterating with any content on this website, you agree to be bound by these Terms, including the policies referenced in these Terms.

THESE TERMS INCLUDE AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT APPLY TO ALL CLAIMS BROUGHT AGAINST YOGAJAYA. HOWEVER, THE TERMS OF THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SHALL NOT APPLY IF UNENFORCEABLE UNDER THE LAWS OF THE COUNTRY IN WHICH YOU RESIDE.

Acceptance of the Terms
1. These Terms of Use (“Terms”) govern your access to and use of the website located at https://learn.yogajaya.com/ (the “YogaJaya Education website”, or “Website”) as well as your use of the Services provided through this Website. By using the Website, you (“User”, “you” or “your”) are agreeing to be bound by these Terms.
2. The Website is controlled and operated by YogaJaya Intl., a company incorporated in Canada, and offers products and services (collectively, “Services”) provided by YogaJaya Intl., its subcontractors, and its international partners, including Para Impacto Ltd., a company, incorporated in Japan (collectively, “YogaJaya”, “us,” “we,” or “our”).
3. These Terms may be amended from time to time without notice. If YogaJaya updates these Terms, it will post the updated Terms on the Website and will notify all active users by email. Your continued use of the Website following the posting of any such amendments will mean that you have accepted the updated Terms.

Use of the Website
1. Any use or access by anyone under the age of 16 is strictly prohibited.
2. You may use the Website for your personal, noncommercial use. You may not copy, reproduce, distribute, display, or create derivative works from the Website without the prior written permission of YogaJaya. You are permitted to print or copy any part of the Website as long as it is exclusively for your own personal use to aid in the process of studying the content provided through the Website.
3. You can create, access, and/or use only one user account, and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access.
4. Providing false contact information of any kind may result in the termination of your account.
5. You may not post content or make verbal statements during the live sessions that are defamatory, fraudulent, obscene, threatening, invasive of another person’s privacy rights or that are otherwise unlawful.
6. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any part of these Terms or that your conduct or content would tend to damage our reputation and goodwill.
7. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.
User content
1. We may, but have no obligation to, monitor and review the data, information or material (collectively, “Content”) that you submit on the Website or using our Services.
2. You grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account as required for the purpose of providing the Services to you.
3. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable.
4. You also grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose, to the extent that it does not violate your privacy, according to our Privacy policy.
5. Some user content is automatically generated by the Website as a part of the paid Service offerings (including but not limited to course progression record, quiz completion information, online practice record, accumulated points).
6. If a subscription to paid Services is canceled, either by you or as a result of the inability to process payment via the payment method you provided, some of the automatically generated content (including but not limited to course progression record, quiz completion information, online practice record, accumulated points) will be deleted.
Intellectual Property
1. All intellectual property rights in the Website (including, without limitation, all text, videos, graphics, logos, icons, audio clips, and software) are owned by YogaJaya or its licensors. You may not copy, reproduce, distribute, display, or create derivative works from the Website without the prior written permission of YogaJaya.
Accuracy of Information
1. All the information contained in the Website or distributed through the Website is provided “as is” without any representation or warranty of any kind, either express or implied. YogaJaya does not warrant that the Website will be constantly available, error-free, or that the content is appropriate for any particular purpose.
2. YogaJaya will not be liable for any loss or damage whatsoever including, without limitation, indirect or consequential loss, loss of profits, loss of data, or loss of opportunity arising from the use of the Website, whether or not YogaJaya has been advised of the possibility of such loss or damage.
Health Disclaimer
1. By using the Services, you represent that you understand that there may be risks of injury, whether physical or mental, associated with participating in physical activities presented on or through the Website for people in good or poor health, pregnant women, or people with pre-existing physical or mental health conditions. If you choose to participate in physical activities, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with physical activities.
2. The information available on the Website and provided through our Services is not intended to be a substitute for professional medical advice, diagnosis or treatment. You should not rely exclusively on information provided on or through the Website for your health needs. All specific medical questions should be presented to your own health care provider and you should seek medical advice regarding your health before starting any type of physical practice or physical education program.
3. You understand that it is your responsibility to judge your physical and mental capabilities for any activities. It is your responsibility to ensure that by participating in activities as a part of Services, you will not exceed your limits while performing an activity, and you will select the appropriate level of activity for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have.
4. You understand that, if our teaching staff instructs you to perform certain movements or gives you advice on how to perform certain movements, it is your sole responsibility to determine if any direction or advice is appropriate for your level of ability and physical and mental condition.
5. You expressly waive and release any claim that you may have at any time for injury of any kind against YogaJaya, or any person or entity involved with YogaJaya, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.
6. Unless it is clearly stated in writing in your Profile form, it is deemed that: (i) you are not suffering from any physical or psychological illness; (ii) you are not taking any medication or other drugs; (iii) you are not pregnant.
7. You are individually responsible for recognizing that it can be contraindicated for health to perform certain physical movements in certain medical conditions or under the influence of medication or other drugs.
8. If any illness or other irregular physical or mental condition (which might or might not involve any medication or other drugs), including becoming pregnant, arises while using the Service after you have informed YogaJaya through the Profile form about the absence of any irregular conditions, you will be individually responsible for consulting your physician and informing YogaJaya about the change of your condition.
9. In the case that you have or newly develop any illness or other irregular physical or mental condition (which might or might not involve any kind of medication or other drugs) or become pregnant while using the Services, YogaJaya retains the full discretionary right to exclude you from participation in any Services to prevent any complications related to your illness or general health condition without refund.
Access to Paid Services
1. The Website offers paid Services. Unless otherwise stated, fees are set in US dollars, although the amount at checkout may be converted to your local currency based on your billing address, based on the rate determined by a third party software used to provide payment services on the Website.
2. You are responsible for paying all fees charged by or for YogaJaya and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. If your payment method fails or your account is past due, we may terminate your access to certain paid Services.
3. YogaJaya reserves the right to change any fees or pricing plans at any time at its sole discretion. Any change, update, or modification will be effective immediately upon posting through the relevant Services.
4. Refunds may or may not be available for paid Services as described in our Payments and Refund Policy. You are encouraged to research and consider whether the fees required to get access to paid Services align with your professional and financial goals.
5. If auto-renewal is enabled for the Services you have subscribed for, you will be charged automatically in accordance with the term you selected.
6. If, in our judgment, your purchase constitutes a high-risk transaction, we may require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We also reserve the right to refuse or cancel any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
7. If a subscription to paid Services is canceled, either by you or automatically as a result of the inability to process the payment via the payment method you provided, any prepaid Credit balance (see Payment and Refund policy for more details) will expire after 3 months from the last valid date of your subscription to paid Services.
8. The online Baseworks Practice classes offered as a part of the subscription to paid Services are meant to be accessed in combination with other learning content (including but not limited to video lecture lessons). If it is determined that you are exclusively or predominantly accessing the online Baseworks Practice classes, your subscription may be canceled without the possibility to re-subscribe. If you are interested either exclusively or predominantly in Baseworks Practice online classes, we recommend subscribing to the Baseworks Practice Platform. This clause is set in place to promote the fair use of our products and services in accordance with the agreement for the YogaJaya Education Platform’s limited permission to use the Baseworks Teaching Methodology and the Baseworks Practice intellectual property as a part of the YogaJaya Teacher Training curriculum.
Access to Live In-person Services
1. Some Services are offered live, in-person, either one-on-one with a teaching staff or in groups with other users (“In-person Services”).
2. If you wish to access In-person Services, you agree to participate in In-person Services in a responsible manner, to be respectful to the teaching staff and other participants, refrain from any disruptive behavior that may interfere with the process of offering In-person Services, and adhere to the guidelines and protocols for participating in and scheduling the In-person Services.
3. In order to make use of the In-Person Services, you must have access to stable internet connection and own or otherwise lawfully obtain a device(s), such as a personal computer, tablet, or smartphone, which would allow watching videos online, recording and uploading video files of no less than 720p HD format, downloading and uploading files, presenting yourself clearly with an acceptable quality microphone and webcam or otherwise of no less than 3 megapixels in resolution during the virtual meetings conducted as part of In-Person Services.
4. YogaJaya has the full discretionary right to change the teaching staff and In-person Service session schedules due to circumstances such as but not limited to the teaching staff being ill, injured, pregnant, going abroad for urgent personal reasons or continuing education/training, delays in transportation/arrival.
5. The In-person Service sessions may require a minimum number of attendees per session, and therefore YogaJaya has the full discretionary right to reschedule if the attendance has not reached the set minimum.
Video, Audio and Screen recording during In-Person Services
1. Some In-Person Services involve live in-person meetings, either one-on-one between you and a teaching staff, or in a form of group meetings with the teaching staff, you, and other participants. Such meetings require the camera to be turned on during the meeting. Such meetings may be recorded by our teaching staff and automatically uploaded to be stored on our secure server.
2. The details of how the recorded videos are handled and used may be found in our Privacy policy.
3. Only YogaJaya-authorized people may photograph, videotape, or record any part of the In-Person Services, unless specifically permitted. If no permission specific is given, you are not allowed to record in any way any part of the In-Person Services.
Changing or Terminating our Services
1. We are constantly changing and improving our Services. We may add or remove functions, features, or requirements, and we may suspend (to the extent allowed by applicable law) or stop part of our Services altogether. Accordingly, YogaJaya may terminate your use of any Service for any reason.
2. If your use of a paid Service is terminated, a refund may be available under our Refund Policy.
3. We may not be able to deliver the Services to certain regions, or countries, or time zones for various reasons, including but not limited to due to internet access limitations, subcontractors’ schedule availability limitations, and restrictions from governments.
4. None of YogaJaya, its content providers and instructors, its contributors, sponsors, and other business partners, and their employees, contractors, and other agents shall have any liability to you for any such action. You can stop using our Services at any time.
Reviews and Testimonials Disclaimer
1. Testimonials are received in various forms through a variety of submission methods. They are individual experiences, reflecting experiences of those who have used our Services in some way or another. However, they are individual results and results do vary.
2. We do not claim that they are typical results that consumers will generally achieve. The testimonials are not necessarily representative of all of those who will use our Services, and YogaJaya is not responsible for the opinions or comments available on the Website, and does not necessarily share them. All opinions expressed are strictly the views of the reviewers.
3. The results obtained from the information available on or through the Website may vary, and will be based on your individual background, physical health, previous experience, capacity, ability to act, motivation, and other variables. There are no guarantees concerning the level of success you may experience.
4. Some testimonials may have been edited for clarity, translated from another language, or shortened in cases where the original testimonial included personal information or information of no relevance to the general public.
5. Testimonials may be reviewed for authenticity before they are available for public viewing.
Assessment criteria, Affiliation, and Accreditation
1. YogaJaya has its own criteria to assess practice performance and teaching performance.
2. The criteria for assessing teaching performance will be explained to individuals who wish to receive Services involving teaching practice and assessment at an appropriate point in time as a part of Services.
3. YogaJaya makes efforts and implements measures to ensure that all staff are familiar with the criteria, and that they apply the criteria to teaching assessment in an unbiased and respectful manner, with the purpose to give accurate feedback about the individual’s teaching performance.
4. If you wish to participate in Services involving teaching practice and assessment, you agree to accept the authority of the teaching staff in assessing your teaching performance.
5. YogaJaya has its own “YogaJaya Level 1 Teacher Training” course completion criteria, which are explained in different places in the Website. If you have fulfilled all the “YogaJaya Level 1 Teacher Training” course completion criteria, course completion will be awarded based on this.
6. Upon recognition of completion of the YogaJaya Level 1 Teacher Training, you will become eligible for registration with Yoga Alliance Registration (RYT200), and you will be issued a certificate confirming your eligibility.
7. Registering with Yoga Alliance requires meeting the YogaJaya Level 1 Teacher Training course completion criteria, applying directly to the Yoga Alliance (on the Yoga Alliance website), and being individually responsible for paying the Yoga Alliance annual fees to register and maintain the your Registered Yoga Teacher (RYT) Yoga Alliance website public listing.
8. The Yoga Alliance has its own criteria for maintaining RYT listings based on paying annual fees and participating in continuing education programming, which YogaJaya is not responsible for.
9. YogaJaya is not responsible for assisting with any administrative tasks, disputes, or claims that any YogaJaya Teacher Training course graduate may have with the Yoga Alliance.
Uptime guarantee and Content Backups
1. We offer a Service uptime guarantee of 99% of available time per month. The service uptime guarantee does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) interruptions caused by you or your activities; (3) outages that do not affect core Service functionality; (4) causes beyond our control or that are not reasonably foreseeable; and (5) outages related to the reliability of certain programming environments.
2. We perform regular backups of the Website and its Content and will do our best to ensure completeness and accuracy of these backups.
3. In the event of the hardware failure or data loss we will restore backups to minimize the impact and downtime. You agree that we will not be in any way responsible for the Content loss that may occur as a result of restoration of a backup.
Indemnification
1. You agree to indemnify and hold YogaJaya and its subsidiaries, affiliates, subcontractors, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Website, your violation of these Terms, or your violation of any rights of another.
Disclaimer of Warranties
1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ACCESS TO THE WEBSITE, INCLUDING, WITHOUT LIMITATION, ALL CONTENT, MATERIALS, PRODUCTS, SERVICES, AND INFORMATION AVAILABLE THROUGH OR OTHERWISE RELATED TO THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, YogaJaya DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE, NONINFRINGEMENT, OR ACCURACY.
2. We make no warranty that the Services will meet your requirements or expectations, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Website or as to the accuracy or reliability of any information obtained through the Website or that defects in the Website or Services will be corrected.
3. We do not guarantee that the core technical functionalities on the Website will be compatible with your device, operating system, browser, internet quality provided by your provider, enabled software, privacy settings or other services.
Limitation of Liability
1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL EITHER YogaJaya OR ITS AFFILIATES, OFFICERS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE WEBSITE, WITH THE DELAY OR INABILITY TO USE THE WEBSITE, OR WITH ANY INFORMATION OR MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE WEBSITE, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN SUCH INFORMATION OR MATERIAL, EVEN IF YogaJaya HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY APPLIES TO ANY CAUSE OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF YogaJaya HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
General
1. These Terms constitute the agreement between you and YogaJaya with respect to your use of the Website and our Services. If any part of these Terms is held invalid, the rest of these Terms will remain in effect.
2. If you violate these Terms, or do not abide by referenced policies, your permission to use the Website may be terminated.
3. These Terms are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. You and YogaJaya agree to submit to the personal jurisdiction of the courts located in the Province of Quebec, Canada.
Changes and amendments
1. We reserve the right to modify these Terms at any time, effective upon posting of an updated version of these Terms on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.

Payments and Refund Policy

For details on our refund and cancellation policies, please refer to the information below. Please note that our policies differ depending on the purchased Service, and payment options may vary. Please also note that we treat violations of our Terms and Honor Code very seriously, and we have no obligation to offer refunds to users who violate these or other YogaJaya policies, even if their requests are made within the designated refund period.

1. Recurring Monthly Subscriptions

1.1 YogaJaya does not offer refunds for payments made on any monthly subscription plans.

1.2 Your subscription will continue on a monthly basis unless and until you cancel or the subscription is suspended or discontinued by YogaJaya.

1.3. If you cancel your subscription, cancellation will be effective at the end of the current monthly period. You will continue to have access to your subscription for the remainder of that period, but you will not receive a refund.

2. “Credits” for In-Person sessions

2.1 YogaJaya Education website offers various live educational formats on a prepaid basis based on a system of Credits (including FFS Credit, CS Credit, TFS Credit, TA Credit). According to this system, one Credit of a particular type is required to participate in one live In-Person session of a particular kind (for example, 1 FFS Credit to participate in 1 FFS session). Credit purchase enables booking live sessions, however Credit points get deducted from your account at the moment when you join live sessions.

2.2. Credits will be deducted without possibility of refund if you miss a “fixed” pre-booked session, unless you can provide proof of serious and unforeseen circumstances that made it impossible or very difficult for you to attend the session.

2.3. Prepaid but unused Credit will not be refunded if you decide to stop or suspend using the Website or our Services. It is your responsibility to manage your schedule and other commitments and anticipate to what extent you will be able to participate in the live sessions provided through the YogaJaya Education website.

2.4. If YogaJaya chooses to stop offering a live-session based In-person Service, for which you have already purchased pre-paid Credit for, YogaJaya will notify you about this and will refund your unused Credit.

2.5. Credit’s validity period depends on the status of your recurring subscription. As long as your subscription is active, the validity period of any Credit is unlimited. However, if your subscription is canceled, either by you or automatically as a result of the inability to process the payment via the payment method you provided, any prepaid Credit will expire after 3 months from the last valid date of your subscription without refund.

3. Exam fees

3.1 Exam fees are non-refundable.

3.2 Some exams on the Website may have time limits, counted from the time you start the exam. It is your responsibility to choose the time when you can take the exam without interruption and that you have stable internet access for the whole duration of the exam. However, if you can provide proof that there was an internet or power outage after you have started the exam, or that there were serious and unforeseen circumstances that occurred after you have started the exam and prevented you from completing it, YogaJaya may allow you to retake the exam without paying the fee again.

4. Violations of Terms and Honor Code

4.1 We treat violations of our Terms of Use and Honor Code very seriously, and we have no obligation to offer refunds to users who violate these or other YogaJaya policies.

4.2 We have no obligation to offer refunds to users who do not receive a passing score or who are otherwise unsatisfied with the learning content on the YogaJaya Education website.

5. Changes to Price and Subscription Plans

5.1. We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.

5.2. Except as otherwise expressly provided for in our Terms, any price changes to your subscription plan will take effect following notice to you.

Honor Code

All users using the YogaJaya Education website, must agree to abide by the following code:

1. You will be polite to the teaching staff and other participants.

2. Your answers to quizzes, exams, and other assignments must be your own work (except for assignments that explicitly permit or require collaboration).

3. You will not make solutions to quizzes, exams, and other assignments available to anyone else (except to the extent an assignment explicitly permits sharing solutions). This includes both solutions written by you, as well as any solutions provided by the teaching staff.

4. You will not engage in any other activities that will dishonestly improve your results, such as editing your video-based assignments or using Artificial Intelligence (AI) services to write your assignments.

5. You will be responsible, proactive, and conscientious in all matters related to scheduling, rescheduling, and attending in-person sessions, either one-on-one with a teaching staff or together with other participants.

6. You will not engage in any advertising, promotion of commercial programs, or self-promotion in any public social spaces, such as groups, forums, activity feeds, timelines. You can post information about your activities in your personal profile, including the links to your social media profiles and/or website(s). However you should refrain from posting specific information about pricing, promotional offers, etc.

Any violation of this code may result in your access to all or part of the Services being suspended, disabled, or terminated.
